Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MediaForge website at mediaforgetools.com, including its file-conversion, URL-based media processing, audio-extraction, video-conversion, and related tools (together, the "Service").

MediaForge is an independent service operated by an individual based in Canada (the "Operator"). In these Terms, "MediaForge," "we," "us," and "our" refer to the Operator and the Service as the context requires. By accessing the Service or submitting a conversion request, you agree to these Terms, our Privacy Policy, and our Copyright & Acceptable Use Policy. If you do not agree, do not use the Service.

1. About MediaForge

MediaForge provides general-purpose media-processing and conversion tools. Depending on the feature you select, the Service may let you upload media files; submit URLs pointing to media or media sources; extract audio into MP3 or another supported format; convert, remux, or repackage video into MP4 or another supported format; and perform other media operations we make available.

MediaForge provides only the technical means to perform a conversion you request. It does not grant you ownership of, a licence to, or any other right in third-party content. The fact that the Service is technically able to access or process a particular file, URL, website, stream, or other source does not mean that downloading, copying, converting, extracting, storing, or otherwise using that material is authorized.

2. Eligibility

You may use the Service only if you can lawfully enter into an agreement governing your use of it. If your local law requires the permission of a parent or guardian, you may use the Service only with that permission. If you use MediaForge on behalf of an organization, you confirm you are authorized to accept these Terms for it.

3. Your responsibility for submitted content

You are responsible for every file, URL, media source, and other item you submit ("Submitted Content"). You may submit content only where you have a lawful basis to perform the conversion you request — for example content that you created or own, that you are licensed or permitted to use, that is in the public domain, that is offered under a licence permitting the requested use, or that you are otherwise legally entitled to copy or process.

By submitting content, you represent and warrant that your requested use of the Service does not violate applicable law or the rights of anyone else. You are responsible for determining whether copyright, contractual restrictions, licensing terms, or other rights affect your ability to use particular content. MediaForge does not provide legal advice and does not decide whether a particular conversion qualifies for any copyright exception in your jurisdiction.

4. Third-party websites and media platforms

MediaForge may be technically able to process URLs or media associated with third-party websites, video platforms, hosting services, social networks, or other online services. You are responsible for complying with any terms, restrictions, licences, or conditions that legally apply to your access to and use of those services. You must not use MediaForge to obtain or process content where doing so would violate applicable law; infringe copyright or another intellectual-property right; breach a binding restriction on your use of the source service; bypass an access restriction or technical protection measure; or reach content you are not authorized to access.

Technical acceptance of a URL by MediaForge is not authorization, approval, or a determination that your intended use is lawful. We may support, restrict, discontinue, or refuse particular websites, domains, sources, formats, or conversion methods at any time.

5. No affiliation with third-party platforms

MediaForge is independent. Unless we expressly say otherwise, we are not affiliated with, endorsed by, sponsored by, or operated by any third-party website, platform, publisher, or rights holder whose content may be compatible with the Service. All third-party names, logos, and trademarks remain the property of their owners and are referenced only to identify compatibility or the origin of content.

6. Copyright and intellectual property

MediaForge respects copyright and other intellectual-property rights. You must not use the Service to knowingly reproduce, convert, distribute, or otherwise use copyrighted material without authorization or another lawful basis; create or distribute unauthorized copies; infringe copyright, trademark, publicity, privacy, or other proprietary rights; remove or alter rights-management information in violation of law; facilitate another person's infringement; or misrepresent your ownership of or authority over Submitted Content. Changing a file's format does not change the copyright or other rights that may apply to the underlying work.

7. Technical protection measures and access controls

You may not use MediaForge to defeat, bypass, disable, or interfere with digital rights management (DRM), encryption, copy protection, authentication requirements, paywalls, access controls, security mechanisms, or other effective technological protection measures. You may not provide the Service with stolen, unauthorized, or improperly obtained credentials, cookies, session data, access tokens, or keys in order to obtain restricted content. We may refuse any conversion that appears to require prohibited circumvention or unauthorized access.

8. General acceptable use

You may not use or attempt to use MediaForge for unlawful activity; to infringe another person's rights; to process material obtained through unauthorized access; to distribute malware or intentionally harmful files; to interfere with the operation, security, or availability of the Service; to bypass rate limits, usage limits, source restrictions, or abuse-prevention systems; to impersonate another person or falsely claim authority over content; to probe, scan, attack, or overload our infrastructure; to place unreasonable automated load on the Service; to resell or systematically exploit the Service without our authorization; or to help anyone else do these things. We may use automated and manual measures to prevent abuse, enforce limits, and protect the Service.

9. No pre-clearance of content

MediaForge does not undertake to determine the ownership, copyright status, licensing, source authorization, or intended use of every item submitted. A technically successful conversion has not been legally reviewed or cleared. Responsibility for obtaining the rights or permissions needed for a conversion remains with you. Nothing here limits our ability to investigate complaints, restrict sources, reject requests, disable access, or take other appropriate action.

10. Licence to process your content

You keep whatever rights you have in Submitted Content. Solely to provide the Service, you grant the Operator a temporary, non-exclusive, worldwide licence to access, retrieve, copy, transmit, encode, decode, extract, convert, remux, temporarily store, and otherwise technically process Submitted Content as reasonably necessary to complete your requested conversion, deliver the result to you, maintain the functionality and security of the Service, prevent fraud and abuse, and comply with applicable law. This licence does not transfer ownership to MediaForge and ends when the relevant content is deleted from our systems, except for limited information we must lawfully preserve for security, legal compliance, or dispute resolution.

11. Temporary processing and deletion

MediaForge is a conversion tool — not file hosting, cloud storage, or a backup service. Submitted media and generated output are stored only transiently, for as long as a conversion requires:

You are responsible for downloading your output before it expires and for keeping your own backups. Retention of non-media operational data — such as security logs and aggregate analytics — is described in our Privacy Policy.

12. Conversion results

Conversion may change a file's technical characteristics through transcoding, compression, audio extraction, remuxing, metadata changes, or other processing. We do not guarantee that every file or URL can be processed, that any source stays supported, that metadata is preserved, that output matches the source, that output is compatible with every device, or that a conversion completes successfully. You are responsible for checking that converted files meet your needs.

13. Usage limits

We may impose limits — including on file size, media duration, bandwidth, number of conversions, processing frequency, supported formats, supported sources, quality, temporary storage, and concurrent processing — and may vary them based on capacity, security, abuse prevention, or availability. We may throttle, queue, reject, or cancel jobs where reasonably necessary to operate or protect the Service.

14. Copyright and illegal-content notices

Copyright owners, their authorized representatives, and others who believe the Service is being used in connection with unlawful content may contact us at legal@mediaforgetools.com. A notice should include enough information for us to understand and evaluate the complaint, including where applicable: identification of the work or right involved; the URL, source URL, file identifier, or other information reasonably sufficient to identify the activity; an explanation of why the activity is alleged to be unlawful; your name and contact information; a good-faith statement that the information is accurate; and evidence of your authority to act where you submit on behalf of a rights holder. 15. Enforcement

We reserve the right to take action we consider appropriate to operate and protect the Service and to comply with the law. We do not set out specific enforcement steps here; any action is considered on a case-by-case basis.

16. Privacy

Our handling of personal data is governed by the MediaForge Privacy Policy, which also explains our use of cookies, analytics, advertising, logs, retention periods, and your privacy rights.

17. Advertising and third-party services

MediaForge is ad-supported and may display advertising or rely on third-party infrastructure, analytics, security, content-delivery, or advertising providers. An advertisement is not an endorsement by MediaForge. The real download is never an advertisement, and a failed or blocked ad never withholds your file. Third-party sites and services operate under their own terms and privacy practices, and we are not responsible for external sites you choose to visit.

18. Availability and changes to the Service

The Service is provided on an "as available" basis. We may add, modify, restrict, suspend, or discontinue features — including particular formats, sources, limits, and conversion methods — and third-party sites may change their systems in ways that affect functionality. We do not guarantee the continuous availability of any feature or source.

19. Disclaimer of warranties

To the maximum extent permitted by law, MediaForge is provided "as is" and "as available." We make no guarantees about uninterrupted availability, conversion success, compatibility, accuracy, reliability, quality, or fitness for a particular purpose, and we disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes any warranty, statutory guarantee, or consumer right that cannot legally be excluded.

20. Limitation of liability

To the maximum extent permitted by law, the Operator and those acting on the Operator's behalf will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Service, including — where legally permitted — loss of profits, revenue, business, goodwill, or data. In particular, we are not responsible for losses resulting from expired or deleted temporary files; unsuccessful, incomplete, or incompatible conversions; loss of metadata or quality; your unauthorized use of third-party content; actions taken by third-party platforms; third-party websites or services; or interruptions outside our reasonable control. Nothing here excludes or limits liability where doing so would be unlawful, and mandatory consumer protections are unaffected.

21. Indemnification (business users)

This section applies only where you use the Service in connection with a business, profession, organization, or commercial activity, and only to the extent permitted by law. You agree to indemnify and hold harmless the Operator from third-party claims, damages, liabilities, losses, and reasonable legal expenses arising directly from content you submitted without the necessary rights; your unlawful use of the Service; your infringement of another person's intellectual-property rights; or your material breach of these Terms. This does not apply to the extent a claim results from the Operator's own unlawful conduct or from circumstances where indemnification is prohibited by law.

22. Suspension and termination

You may stop using MediaForge at any time. We may suspend, restrict, or terminate access where reasonably necessary to enforce these Terms; address infringement or other unlawful use; prevent fraud or abuse; protect the Service's security or infrastructure; comply with a legal obligation; or protect the rights or safety of MediaForge, our users, or third parties. Where the law requires advance notice, reasons, or an opportunity to challenge a decision, we will provide those protections.

23. Changes to these Terms

We may update these Terms to reflect changes to the Service, the law, security requirements, or legitimate operational needs. The date at the top identifies the most recent revision. Where a material change significantly affects your use and the law requires notice, we will provide it in an appropriate manner. Continued use after revised Terms take effect means you accept them to the extent permitted by law.

24. Governing law and consumer rights

These Terms are governed by the laws of Canada, without regard to conflict-of-law rules. If you are a consumer, this choice of law does not deprive you of the mandatory protections of the law that would otherwise apply to you, and nothing here requires you to bring a dispute anywhere that your local consumer law entitles you to proceed closer to home.

25. General

If any provision of these Terms is held invalid or unenforceable, it will be limited to the minimum extent necessary to make it enforceable, and the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the Copyright & Acceptable Use Policy, are the entire agreement governing your use of the Service.
